Terms of Service

The short version: the AI gives you a starting point, not a verdict. Don't make safety-critical repair decisions on its word alone. Beyond that, the usual: no warranty, fair use, subscription billed by Apple.

1. The deal

These Terms govern your use of Car Mechanic - Pocket AI (the “App”), an iOS app built and operated by Moses Smith (“we”, “us”). By installing or using the App you agree to these Terms. If you don’t agree, don’t use the App.

2. What the App does

The App provides:

  • AI-generated diagnoses based on text descriptions of vehicle problems
  • AI-generated diagnoses based on photos of vehicle parts, leaks, dashboards, or visible damage
  • AI follow-up chat for clarifying questions about a diagnosis
  • Severity ratings (1–5) and ballpark cost estimates for likely repairs
  • On-device history of past diagnoses and a basic maintenance reminder system

3. Important — informational only

The App is not a substitute for a qualified mechanic. AI-generated diagnoses are based on patterns in language and images and can be wrong. Cars are mechanical systems with safety consequences. For anything involving brakes, steering, suspension, airbags, fuel systems, structural rust, or any condition that could cause a crash or injury, have a licensed automotive professional inspect the vehicle in person before acting on what the App says.

You agree not to make safety-critical repair, drive, or no-drive decisions solely on the App’s output.

4. Subscriptions, billing, and trials

4.1 Plans

  • Yearly — $29.99 per year, with a 3-day free trial for new users
  • Monthly — $3.99 per month

4.2 Billing

  • Charges are made by Apple to your Apple ID. We never see your card.
  • Subscriptions auto-renew until cancelled. Apple charges your payment method within 24 hours before the end of each period.
  • You can manage or cancel from Settings → Apple ID → Subscriptions on your iPhone, or via apps.apple.com/account/subscriptions.
  • Cancelling stops the next renewal but doesn’t refund the current period. Refund requests for the current period go to Apple via reportaproblem.apple.com.

4.3 Free trial

New subscribers may receive a 3-day free trial on the yearly plan. If you don’t cancel before the trial ends, the subscription automatically begins and is charged. You only get one trial per Apple ID per subscription group, in line with Apple’s rules.

5. Acceptable use

  • Use the App for personal, non-commercial vehicle questions.
  • Don’t use the App to provide professional repair advice to other people for money without disclosing that the source is an AI tool.
  • Don’t reverse-engineer, scrape, or attempt to extract the underlying prompts or models.
  • Don’t submit content that is illegal, harmful, or that you don’t have the right to share (e.g., photographs of someone else’s vehicle taken without permission, where permission is required).

6. Your content

You keep ownership of the descriptions, photos, and chat messages you submit. You grant us a limited, non-exclusive licence to use that content solely for the purpose of generating diagnoses through our AI provider, displaying them back to you, and storing the resulting summary on your device.

We do not use your content to train AI models. See the Privacy Policy for details.

7. No warranties

The App is provided “as is” and “as available”. We disclaim all warranties, whether express, implied, statutory or otherwise, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We don’t guarantee that the AI’s diagnoses will be correct, complete, timely, or suitable for any specific vehicle.

8. Limitation of liability

To the maximum extent permitted by law, in no event will we be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or vehicle damage arising out of or relating to your use of (or inability to use) the App or any diagnosis it produces.

Our total cumulative liability for any claim arising out of these Terms or the App shall not exceed the greater of (a) the amount you paid for the App in the 12 months preceding the claim, or (b) US$50.

9. Indemnity

You agree to indemnify and hold us harmless from any claim brought by a third party arising out of (i) your misuse of the App, (ii) repair or driving decisions you made based on the App’s output, or (iii) your violation of these Terms.

10. Termination

You can stop using the App at any time by deleting it from your device and cancelling any active subscription. We may suspend or terminate access if you violate these Terms or use the App in a way that creates risk for us or other users.

11. Changes to the App and the Terms

We may add, change, or remove features over time. If a change to these Terms is material, we’ll update the effective date and surface a notice in the App before it takes effect for you.

12. Governing law and disputes

These Terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Texas, except that either party may seek injunctive relief in any court of competent jurisdiction. Nothing in this section limits any non-waivable consumer rights you have under your local law.

13. Apple-specific terms

These Terms are between you and us, not Apple. Apple is not responsible for the App or any claim relating to the App. Apple is a third-party beneficiary of these Terms with the right to enforce them against you. In the event of a conflict between these Terms and Apple’s standard EULA for App Store apps, the more protective provision (for you) applies.

14. Severability and entire agreement

If any part of these Terms is held unenforceable, the rest stays in effect. These Terms, together with the Privacy Policy, are the complete agreement between you and us regarding the App.
